जयपुर। जिले की पॉक्सो मामलों की विशेष अदालत ने नाबालिग से दुष्कर्म करने वाले अभियुक्त प्रकाश यादव को बीस साल की सजा सुनाई है। इसके साथ ही अदालत ने एक लाख रुपए का जुर्माना भी लगाया है। अदालत ने अपने आदेश में कहा कि भले की प्रकरण की पीडिता और उसके माता-पिता अपने बयानों से पलट गए हो, लेकिन डीएनए रिपोर्ट से साबित है कि अभियुक्त और पीडिता के बीच संबंध बने थे। वहीं अभियुक्त और पीडिता की ओर से होटल के रजिस्टर में किए साइन भी जांच में समान मिले हैं।
पीडिता के नाबालिग होने के चलते उसकी सहमति कानून में कोई महत्व नहीं रखती है। अदालत ने अपने आदेश में कहा कि पीडिता मामले में पक्षद्रोही हुई है। इसलिए उसे पीडि़त प्रतिकर स्कीम के तहत किसी प्रकार की क्षतिपूर्ति राशि भी नहीं दी जाए। अभियोजन पक्ष की ओर से विशेष लोक अभियोजक विजया पारीक ने अदालत को बताया कि पीडिता के पिता ने 23 मार्च, 2023 को कालाडेरा थाने में रिपोर्ट दर्ज कराई थी। रिपोर्ट में कहा गया कि उसकी 14 साल की बेटी एक दिन पहले स्कूल गई थी, लेकिन वापस नहीं लौटी। रिपोर्ट पर कार्रवाई करते हुए पुलिस अभियुक्त को गिरफ्तार कर अदालत में आरोप पत्र पेश किया।
सुनवाई के दौरान पीडिता और उसके माता-पिता ने कहा कि वह स्कूल से सीधे अपनी सहेली के पास गई थी और अगले दिन वापस आ गई। वहीं होटल मैनेजर ने कहा कि घटना के दिन प्रकाश और पीडिता उसकी होटल में आए थे और एक दूसरे को भाई-बहन बताते हुए कमरा किराए पर लिया था। अलग दिन 23 मार्च को दोनों कमरा खाली कर चले गए, लेकिन कुछ घंटों बाद वापस आकर फिर से कमरा किराए पर लिया। इस दौरान उसने दोनों की आईडी लेकर रजिस्टर में साइन भी कराए थे। कमरा किराए पर लेने के कुछ देर बाद ही वहां पुलिस आ गई और दोनों को लेकर चली गई। सभी पक्षों को सुनने के बाद अदालत ने अभियुक्त को सजा सुनाई है।

The court said in its order that even though the victim and her parents have retracted their statements, the DNA report proves that there was a relationship between the accused and the victim. The signatures made by the accused and the victim in the hotel register were also found to be identical during investigation.
Since the victim is a minor, her consent has no importance in law. The court said in its order that the victim has turned hostile in the case. Therefore, he should not be given any compensation amount under the Victim Compensation Scheme. Special public prosecutor Vijaya Pareek, appearing for the prosecution, told the court that the victim's father had lodged a report at Kaladera police station on March 23, 2023. The report said her 14-year-old daughter had gone to school the day before but did not return. Acting on the report, the police arrested the accused and presented the charge sheet in the court.
During the hearing, the victim and her parents said that she had gone straight from school to her friend's place and returned the next day. The hotel manager said that on the day of the incident, Prakash and the victim had come to his hotel and had rented a room, calling each other brother and sister. On a different day, on March 23, both of them vacated the room, but returned after a few hours and rented the room again. During this time, he took the IDs of both of them and got them signed in the register. Shortly after renting the room, the police came there and took both of them away. After hearing all the parties, the court has sentenced the accused.
