बीकानेर। हत्या के एक मामले में बीकानेर की अदालत ने आठ जनों को आजीवन कारावास की सजा से दंडित किया है। हत्या सत्रह साल पहले हुई थी। इसी मामले में कुछ लोगों को बरी कर दिया गया है। एससी-एसटी कोर्ट के न्यायिक अधिकारी विनोद कुमार वाजा ने इस मामले में सजा सुनाई।
मामला ये है कि एक फरवरी 2006 को श्रीडूंगरगढ़ के सोनियासर मिठिया बास में रामकरण, श्रवणराम, तीजा मेघवाल के खेत में कुछ लोगों ने हमला कर दिया। इस हमले में रामकरण के शरीर पर गंभीर चोट आई और पीबीएम अस्पताल में इलाज के दौरान उसकी मौत हो गई। एफआईआर में आरोप लगाया गया कि रेखाराम, जेठाराम, डेलूराम, दीपाराम, धन्नाराम, चीमादेवी, ईमादेवी, मनोहरलाल, रतिराम, चतराराम, देवाराम, घासीराम, सीताराम ने अपने हाथों में गण्डासी, लाठी, बरछी, कुल्हाड़ी, जेई हथियारों से हमला किया। इस दौरान खेत में श्रवणराम, रामकरण, तीजा थी, इन पर जानलेवा हमला किया गया। जिसमें रामकरण गंभीर रूप से घायल हो गया। इलाज के दौरान उसकी मौत हो गई। श्रवणराम व तीजादेवी के गंभीर चोटे आयी। न्यायालय में इनके विरूद्ध चालान प्रस्तुत किया गया।
न्यायालय में भारतीय दंड संहिता की धारा 302 सहित तेरह अलग-अलग अपराधों से जुड़ी धाराओं के तहत चालान पेश किया गया। इसमें एससी-एसटी एक्ट भी लगाया गया। न्यायालय के समक्ष विशिष्ठ लोक अभियोजक कुंवर कुंदन व्यास ने पक्ष रखा। कुल 30 गवाह के बयान करवाये गये। गंडासी, लाठी, बर्छा, हथियारों व मेडिकल रिर्पोट व एफएसएल रिपोर्ट भी अदालत में पेश की गई। बचाव पक्ष की ओर से तीन गवाह के बयान करवाये गये।
न्यायालय ने विशिष्ठ लोक अभियोजक कुंवर कुंदन व्यास की ओर से पेश गवाह के बयान व दस्तावेज, सबूत, एफएसएल रिपोर्ट व हथियारों की रिर्पोट, मौका रिर्पोट के आधार पर अलग अलग धाराओं में अलग अलग सजा सुनाते हुए सभी पर आरोप प्रमाणित माना गया। मुल्जिम जेठाराम, डेलूराम, धन्नाराम, चीमादेवी, ईमादेवी, मनोहरलाल घासीराम व सीताराम को दोषी मानते हुए
आजीवन कारावास की सजा सुनायी गयी व अर्थदंड के रूप में दो हजार रूपये से दंडित किया गया है। पीड़ित पक्ष मेघवाल जाति के थे, इसलिए एसटी-एसटी एक्ट में कार्रवाई हुई। मुलजिम रेखाराम, रतिराम, चतराराम, दीपाराम को साक्ष्य के अभाव में बरी किया गया है। दीपाराम की दौरान अन्वीक्षा मृत्यु हो गई। उसके विरूद्ध कार्यवाही ड्रॉप की गयी

Bikaner. Bikaner court has sentenced eight people to life imprisonment in a murder case. The murder took place seventeen years ago. Some people have been acquitted in this case. Judicial officer of SC-ST court Vinod Kumar Waja pronounced the sentence in this case.
The matter is that on February 1, 2006, some people attacked the fields of Ramkaran, Shravan Ram, Teeja Meghwal in Soniasar Mithiya Bas of Sridungargarh. Ramkaran suffered serious injuries in this attack and died during treatment at PBM Hospital. It was alleged in the FIR that Rekharam, Jetharam, Deluram, Deeparam, Dhannaram, Cheemadevi, Imadevi, Manoharlal, Ratiram, Chatararam, Devaram, Ghasiram, Sitaram attacked with weapons like gandasi, lathi, lance, axe, etc. in their hands. During this time, Shravanram, Ramkaran and Teeja were in the field and they were fatally attacked. In which Ramkaran was seriously injured. He died during treatment. Shravanram and Teejadevi got serious injuries. Challan was presented against them in the court.
The challan was presented in the court under sections related to thirteen different offenses including Section 302 of the Indian Penal Code. SC-ST Act was also imposed in this. Special public prosecutor Kunwar Kundan Vyas presented his case before the court. Statements of 30 witnesses were taken. Gundasi, sticks, spears, weapons and medical report and FSL report were also presented in the court. Statements of three witnesses were made on behalf of the defence.
On the basis of witness statements and documents presented by Special Public Prosecutor Kunwar Kundan Vyas, evidence, FSL report and weapon report, spot report, the court awarded different punishments under different sections and considered the charges proved on all. Accused Jetharam, Deluram, Dhannaram, Cheemadevi, Imadevi, Manoharlal Ghasiram and Sitaram were found guilty and sentenced to life imprisonment and fined Rs 2,000. The aggrieved parties belonged to Meghwal caste, hence action was taken under ST Act. Accused Rekharam, Ratiram, Chatararam, Deeparam have been acquitted due to lack of evidence. Anviksha died during Deeparam. The proceedings against him were dropped.
