झालावाड़ पोक्सो कोर्ट विशिष्ट न्यायाधीश बृजेश पवार ने नाबालिक किशोरी से दुष्कर्म मामले में बड़ा फैसला सुनाते हुए आरोपी रामेश्वर वर्मा को 20 वर्ष कठोर कारावास की सजा सुनाई है. इसके साथ ही आरोपी को 2 लाख 30 हजार रुपए के अर्थदंड से भी दंडित किया गया है. आरोपी द्वारा अर्थदंड नहीं चुकाये जाने पर 1 वर्ष का अतिरिक्त कारावास भी भुगतना होगा.
मामले की जानकारी देते हुए पोक्सो कोर्ट के लोक अभियोजक रामहैतार गुर्जर ने बताया कि करीब 3 वर्ष पूर्व झालावाड़ जिले के भवानीमंडी थाना क्षेत्र में पीड़िता के पिता ने प्रार्थना पत्र पेश कर रिपोर्ट दी थी, कि आरोपी रामेश्वर वर्मा उसके मकान के सामने किराए के मकान में रहता था और मौका पाकर आरोपी उसकी 14 वर्षीय नाबालिक बालिका को बहला फुसलाकर ले गया. बाद में पुलिस ने आरोपी के खिलाफ आईपीसी की धारा 376 तथा पॉक्सो के तहत मामला दर्ज कर मामले में अनुसंधान शुरू किया तथा पीड़िता को औरैया उत्तर प्रदेश से बरामद किया.
पीड़िता ने मजिस्ट्रेट के समक्ष दिए बयान में बताया कि आरोपी उसे बहला फुसलाकर कर औरैया उत्तर प्रदेश ले गया जहां आरोपी ने उसके साथ कई बार दुष्कर्म किया. लोक अभियोजक रामहैतार ने बताया कि आरोपी रामेश्वर वर्मा 12 अक्टूबर 2020 से ही न्यायिक अभिरक्षा में था. मामले में अभियोजन पक्ष की ओर 13 गवाह तथा 21 दस्तावेज पेश किए गए, जिनको आधार मानते हुए पोक्सो कोर्ट विशिष्ट न्यायाधीश बृजेश पवार ने खड़ा फैसला सुनाते हुए दुष्कर्म के आरोपी रामेश्वर वर्मा निवासी खारपा (पिडावा) को 20 वर्ष का कठोर कारावास तथा 2 लाख 30 हजार रुपए के अर्थ दंड से दंडित किया है. अर्थदंड की राशि न चुकाए जाने पर आरोपी को 1 वर्ष का अतिरिक्त कारावास भुगतना होगा.

Giving information about the case, POCSO Court Public Prosecutor Ramhaitar Gurjar said that about 3 years ago, in Bhawanimandi police station area of Jhalawar district, the victim's father had submitted an application and reported that the accused Rameshwar Verma was living in a rented house in front of his house. He lived there and taking the opportunity, the accused lured his 14 year old minor girl away. Later, the police registered a case against the accused under section 376 of IPC and POCSO and started investigation in the case and recovered the victim from Auraiya, Uttar Pradesh.
The victim told in her statement before the magistrate that the accused lured her and took her to Auraiya, Uttar Pradesh, where the accused raped her several times. Public Prosecutor Ramhaitar said that accused Rameshwar Verma was in judicial custody since October 12, 2020. In the case, 13 witnesses and 21 documents were presented by the prosecution, considering which as the basis, POCSO Court Special Judge Brijesh Pawar, while giving a standing verdict, sentenced rape accused Rameshwar Verma, resident of Kharpa (Pidawa), to 20 years of rigorous imprisonment and a fine of Rs 2 lakh 30. Has been punished with a fine of thousand rupees. If the fine amount is not paid, the accused will have to face additional imprisonment of 1 year.
