धौलपुर। विशेष न्यायालय पॉक्सो कोर्ट ने 15 वर्षीय नाबालिग के साथ बलात्कार करने के मामले में आरोपित चचेरे भाई को दोषी करार देते हुए उसे दस वर्ष के कठोर कारावास की सजा सुनाई है। साथ ही 51 हजार रुपए के जुर्माने से दण्डित किया हैं। आरोपित वर्तमान में फरार है। कोर्ट ने आरोपित को गिरफ्तार कर कर कोर्ट में पेश करने के आदेश दिए हैं।
विशिष्ट लोक अभियोजक संतोष मिश्रा ने बताया कि महिला पुलिस थाना में एक 15 वर्षीय नाबालिग ने अपनी मां के साथ पांच मई 2019 को रिपोर्ट दर्ज कराई थी। जिसमें उसने बताया कि दो मई 2019 को वह राजाखेड़ा इलाके के एक मैरिज होम में से सहेली शादी में से खाना खा कर वापस अपने घर लौट रही थी। तभी रास्ते में उसके चाचा का लडक़ा ने उससे कहा कि मोटरसाइकिल से घर पर छोड़ देगा।
पीडि़ता अपने चचेरे भाई की बाइक पर बैठ गई। चचेरा भाई उसे घर ले जाने के बजाय रात के अंधेरे में एक खेत में लगे बोरिंग पर ले गया, जहां उसने नाबालिग बहन के साथ पिस्टल दिखा कर बलात्कार किया। घटना के बाद आरोपित भाई उसे शमशाबाद पुल पर मारने के लिए ले गया लेकिन पीडि़ता ने घटना के बारे में किसी को नहीं बताने पर आरोपी भाई उसे रात को घर पर छोड़ गया।
आरोपित भाई पीडि़त बहन को उसके भाई और मां को जान से मारने की धमकी देकर भाग गया। पीडि़ता की मां जब शादी में से घर लौट कर आई तो पीडि़ता ने घटना के बारे में बताया। जिस पर पुलिस को अवगत कराया। पुलिस ने आरोपित को डिटेन कर पूछताछ की तो घटना के बारे में उसने कबूल किया। आरोपित नाबालिग होने से पुलिस ने उसे बाल न्यायालय में पेश किया।
जो राजस्थान उच्च न्यायालय से जमानत पर चल रहा है। प्रिंसिपल मजिस्ट्रेट धौलपुर ने नाबालिग की व्यस्कों की तरह सुनवाई करने के लिए मुकदमा पॉक्सो न्यायालय में भेज दिया। पॉक्सो कोर्ट के न्यायाधीश ने आरोपित की ट्रायल व्यस्कों की तरह शुरू कर चार्ज लगाया। पॉक्सो कोर्ट के लोक अभियोजक मिश्रा ने बताया कि मामले में 13 गवाह पेश कर दस्तावेजों को साबित कराया।
प्रकरण में न्यायाधीश जमीर हुसैन ने दोनों पक्षों की बहस और लोक अभियोजक की दलील सुनने के बाद शुक्रवार को 20 वर्षीय आरोपित को दोषी करार देते हुए आईपीसी की धारा 376 व पॉक्सो एक्ट की धारा 5 जी, 6 में दस वर्ष का कठोर कारावास और पचास हजार रुपए के जुर्माने से दण्डित किया है।
साथ ही आईपीसी की धारा 506 में 6 माह का कारावास और एक हजार रुपए के जुर्माने से दण्डित किया है। सभी सजाएं एक साथ चलेगी। लोक अभियोजक मिश्रा ने बताया कि कोर्ट के फैसला सुनाने के दौरान आरोपित व उनके वकील उपस्थित नहीं थे। जिस पर पॉक्सो न्यायाधीश जमीर हुसैन ने महिला पुलिस थाना प्रभारी को आरोपित गिरफ्तार कर कोर्ट में पेश करने के आदेश दिए हैं।

Then on the way, his uncle's boy told him that he would leave the motorcycle at home.
The victim sat on her cousin's bike. Instead of taking him home, the cousin took him to a boring in a field in the dark of night, where he raped the minor sister by showing a pistol. After the incident, the accused brother took him to the Shamshabad bridge to kill him, but the victim did not tell anyone about the incident, the accused brother left him at home at night.
The accused brother ran away threatening to kill his brother and mother to the victim's sister. When the victim's mother returned home from the wedding, the victim told about the incident. On which the police was informed. When the police deemed and questioned the accused, he confessed about the incident. Being a accused minor, the police produced him in the Children's Court.
Which is on bail from the Rajasthan High Court. Principal Magistrate Dholpur sent the case to Poxo Court for hearing a minor like adults. The Poxo Court judge started the trial of the accused like adults and charged. Poxo Court Public Prosecutor Mishra said that the documents were proved by presenting 13 witnesses in the case.
In the case, Judge Jamir Hussain on Friday convicted the 20 -year -old accused after hearing the debate of both sides and the argument of the Public Prosecutor, and Section 376 of the IPC and Section 37 of the IPC and Section 5G of the Poxo Act, ten years rigorous imprisonment in 6 and fifty thousand in fifty thousand Pented with a fine of rupee. Also, Section 506 of the IPC has been punished with imprisonment of 6 months and a fine of one thousand rupees. All the punishment will run together. Public prosecutor Mishra said that the accused and his lawyers were not present during the court's verdict. On which Poxo Judge Jamir Hussain has ordered the woman police station in -charge to arrest the accused and present it in the court.
