सरकारी नौकरियों के लिए राजस्थान सरकार के दो बच्चों के पात्रता मानक को सुप्रीम कोर्ट ने बरकरार रखा है। शीर्ष अदालत ने कहा कि यह भेदभावपूर्ण नहीं है और संविधान का उल्लंघन नहीं करता। राजस्थान विभिन्न सेवा (संशोधन) नियम, 2001 ऐसे अभ्यर्थियों को सरकारी नौकरियां पाने से रोकता है जिनके दो से अधिक बच्चे हैं।

जस्टिस सूर्य कांत, जस्टिस दीपांकर दत्ता और जस्टिस केवी विश्वनाथन की पीठ ने इसके साथ ही भूतपूर्व सैनिक रामजी लाल जाट की अपील खारिज कर दी जिन्होंने 2017 में सेना से सेवानिवृत्ति के बाद 25 मई, 2018 को राजस्थान पुलिस में कांस्टेबल की नौकरी के लिए आवेदन किया था।

पीठ ने कहा कि राजस्थान पुलिस अधीनस्थ सेवा नियम, 1989 का नियम 24(4) गैर-भेदभावपूर्ण है और संविधान का उल्लंघन नहीं करता। यह नियम कहता है कि कोई भी ऐसा अभ्यर्थी सेवा में नियुक्ति के लिए योग्य नहीं होगा जिसके एक जून, 2002 को या उसके बाद दो से ज्यादा बच्चे होंगे। शीर्ष अदालत ने कहा कि इस प्रविधान का मकसद परिवार नियोजन को बढ़ावा देना था।

रामजी लाल की उम्मीदवारी को इस आधार पर खारिज कर दिया गया था कि एक जून, 2002 के बाद उसके दो से अधिक बच्चे थे। इसके बाद रामजी लाल ने राजस्थान हाई कोर्ट का रुख किया था जिसने उनकी अपील को यह कहते हुए खारिज कर दिया था कि जिस नियम के तहत उसे अयोग्य करार दिया गया है वह नीति के दायरे में आता है और इसमें अदालती हस्तक्षेप की जरूरत नहीं है।

हालांकि रामजी लाल की दलील थी कि दो बच्चों का पात्रता मानदंड निर्धारित करने वाले नियमों के अलावा पूर्व सैनिकों को नौकरी में रखने के ऐसे नियम भी हैं जिनमें दो से अधिक बच्चे नहीं होने की शर्त का उल्लेख नहीं है। शीर्ष अदालत ने अपने फैसले में कहा, 'इसे सही मानते हुए हमारा विचार है कि ऐसी दलील अपीलकर्ता के केस आगे नहीं बढ़ाती।

यह अविवादित है कि अपीलकर्ता ने राजस्थान पुलिस में कांस्टेबल पद पर भर्ती के लिए आवेदन किया था और यह भर्ती राजस्थान पुलिस अधीनस्थ सेवा नियमों, 1989 के अधीन आती है। 1989 के इन नियमों को विशेष रूप से 2001 के नियमों से जुड़ी अनुसूची के क्रमांक 104 पर सूचीबद्ध किया गया है। इसके मद्देनजर हमें हाई कोर्ट द्वारा अपनाए गए दृष्टिकोण में हस्तक्षेप का कोई आधार नजर नहीं आता।'

The bench said that Rule 24(4) of the Rajasthan Police Subordinate Services Rules, 1989 is non-discriminatory and does not violate the Constitution. This rule states that no candidate will be eligible for appointment to the service who has more than two children on or after June 1, 2002. Ramji Lal's candidature was rejected on the grounds that he had more than two children after June 1, 2002. After this, Ramji Lal had approached the Rajasthan High Court which had rejected his appeal saying that the rule under which he was disqualified came within the scope of policy and did not require court intervention.

However, Ramji Lal argued that apart from the rules stipulating the eligibility criteria of two children, there are also rules for employing ex-servicemen which do not mention the condition of not having more than two children. The top court said in its decision, 'Considering this to be true, we are of the view that such an argument does not advance the case of the appellant.

It is undisputed that the Appellant had applied for recruitment to the post of Constable in Rajasthan Police and this recruitment falls under the Rajasthan Police Subordinate Services Rules, 1989. These Rules of 1989 are specifically listed at serial number 104 of the Schedule attached to the Rules of 2001. In view of this, we do not see any basis for interference in the approach adopted by the High Court.
