सुप्रीम कोर्ट (Supreme Court) IPC के Section 497 को रद्द कर चुका है. ये सेक्शन शादी के बाद दूसरे के साथ संबंध बनाने को अपराध बनाता था. कोर्ट ने साफ कहा है कि Adultery यानी शादी के बाद किसी दूसरे से संबंध बनाना जुर्म नहीं है. अब सवाल ये आता है कि अगर Adultery अपराध नहीं है तो क्या दूसरा पार्टनर चुपचाप ये सब देखता रहे. कुछ नहीं कर सकता. जी नहीं, ऐसा बिलकुल भी नहीं है. अगर पति या पत्नी का किसी दूसरे के साथ संबंध है तो दूसरे पार्टनर को कानून के तहत अधिकार मिला हुआ है.

India.Com से बात करते हुए सुप्रीम कोर्ट के वकील संदीप मिश्रा बताते हैं कि शादी के बाद कोई भी पार्टनर किसी दूसरे के साथ संबंध बनाता है तो दूसरा पार्टनर उससे तलाक ले सकता है. Adultery तलाक का एक बड़ा आधार है.

उन्होंने आगे ये भी कहा कि अब Adultery यानी विवाह के बाद किसी दूसरे के साथ संबंध गलत नहीं है. लेकिन इस आधार पर दूसरा पार्टनर तलाक ले सकता है. कुल मिलाकर बात ये है कि अगर आपके पति या पत्नी का किसी दूसरे के साथ संबंध है, तो आप कोर्ट जाकर तलाक मांग सकते हैं.

आपको बता दूं, सुप्रीम कोर्ट के फैसले से पहले IPC के सेक्शन 497 के तहत संबंध बनाने वाले पुरुष को ही सजा मिलती थी. महिला इसमें दोषी नहीं मानी जाती थी. संबंधित महिला के पति की शिकायत पर ही मामला दर्ज होता था. इसमें एक तरह से असमानता थी.
