राजस्थान हाईकोर्ट ने आशाराम बापू के जमानत याचिका को खारिज कर दिया, उपचार के लिए अनुमति नहीं

नाबालिग शिष्यों से रेप के केस में जेल में बंद कथावाचक आशाराम बापू को राजस्थान हाईकोर्ट ने बड़ा झटका दिया है. गुरुवार को राजस्थान हाईकोर्ट ने आशाराम बापू की जमानत याचिका को खारिज कर दिया. आसाराम की ओर से उनके वकील ने कथावाचक के उपचार के लिए राजस्थान हाईकोर्ट में जमानत की याचिका लगाई थी. लेकिन कोर्ट ने जमानत आवेदन को खारिज कर दिया है. न्यायाधीश विजय विश्नोई और न्यायाधीश विनित कुमार माथुर की खंडपीठ के समक्ष आसाराम की ओर से उपचार के लिए जमानत देने का आवेदन किया था जिस पर सुनवाई के बाद खारिज कर दिया गया. 

आसाराम की ओर से सुप्रीम कोर्ट के वरिष्ठ अधिवक्ता देवदत्त कामत ने पैरवी करते हुए आसाराम का पक्ष रखा. जिसमें कहा गया कि आसाराम की वर्तमान में 85 साल की उम्र हो गई है और पिछले 11 साल से लगातार जेल में है. पिछले तीन चार माह से लगातार उनको हृदय रोग की शिकायत हो रही है. दो बार एम्स अस्पताल में भर्ती भी करवाया गया है. एम्स के चिकित्सकों ने एंजियोप्लास्टी का सुझाव देते हुए जोखिम भी बताए थे.

महाराष्ट्र में इलाज के लिए जमानत मांग रहे थे आसाराम बापू
जोखिम को देखते हुए आसाराम जोधपुर एम्स में उपचार नहीं करवाना चाहते हैं. इसके बारे में जानकर महाराष्ट्र के माधवबाग में उपचार की सुविधा होने के बावजूद, कोर्ट ने आसाराम के उपचार को लेकर जमानत को स्थगित करने का आदेश दिया है. ताकि उनका उपचार माधवबाग महाराष्ट्र में किया जा सके.

पुलिस कस्टडी में इलाज कराने को तैयार नहीं थे आसाराम बापू 
सरकार की ओर से अतिरिक्त महाधिवक्ता अनिल जोशी ने कहा कि आवेदनकर्ता कहीं और उपचार करवाना चाहता है, तो पुलिस कस्टडी में उपचार करवाने के लिए तैयार है. जिसका खर्चा भी उनको वहन करना होगा. इस पर कोर्ट ने आसाराम के अधिवक्ताओं से जवाब मांगा था. 

आसाराम की ओर से जो जवाब पेश किया, जिसमें वह पुलिस कस्टडी में उपचार को लेकर तैयार नहीं हैं. इसके चलते कोर्ट ने आसाराम की ओर से पेश उपचार के नाम पर जमानत को खारिज कर दिया. कोर्ट ने कहा कि आवेदनकर्ता आसाराम पुलिस कस्टडी में उपचार करवाने के लिए इच्छुक नहीं हैं, तो फिर अपील पर नियमित सुनवाई की जाएगी.

On Thursday, Rajasthan High Court rejected the bail plea of Asharam Bapu. On behalf of Asaram, his lawyer had filed a bail petition in the Rajasthan High Court for the treatment of the narrator. But the court has rejected the bail application. Before the division bench of Justice Vijay Vishnoi and Justice Vineet Kumar Mathur, an application was made on behalf of Asaram for grant of bail for treatment, which was rejected after the hearing.

Senior Supreme Court advocate Devdutt Kamat, appearing on behalf of Asaram, presented Asaram's side. In which it was said that Asaram is currently 85 years old and has been in jail continuously for the last 11 years. He has been complaining of heart disease continuously for the last three-four months. He has also been admitted to AIIMS hospital twice. While suggesting angioplasty, AIIMS doctors also mentioned the risks.

Asaram Bapu was seeking bail for treatment in Maharashtra
Considering the risk, Asaram does not want to get treatment at Jodhpur AIIMS. Knowing about this, despite there being a treatment facility in Madhavbagh, Maharashtra, the court has ordered to postpone the bail of Asaram due to his treatment. So that his treatment can be done in Madhavbagh Maharashtra.

Asaram Bapu was not ready to undergo treatment in police custody
On behalf of the government, Additional Advocate General Anil Joshi said that if the applicant wants to get treatment elsewhere, then the police is ready to get the treatment done in custody. The expenses of which will also have to be borne by them. On this, the court had sought answers from Asaram's lawyers.

The reply presented by Asaram, in which he is not ready for treatment in police custody. Due to this, the court rejected the bail in the name of treatment offered by Asaram. The court said that if the applicant is not willing to get treatment in Asaram police custody, then the appeal will be heard regularly.
