राजस्थान में नई सरकार का गठन होते ही विवाद शुरू हो गए हैं। शुक्रवार 15 दिसंबर को भजनलाल शर्मा के मुख्यमंत्री पद की शपथ लेने के साथ दीया कुमारी और डॉ. प्रेमचंद बैरवा ने उप-मुख्यमंत्री पद की शपथ ली थी। दोनों डिप्टी सीएम के शपथ लेने के बाद ही विवाद शुरू हो गया। एडवोकेट ओमप्रकाश सोलंकी ने राजस्थान हाईकोर्ट में याचिका लगाकर दीया कुमारी और डॉ. प्रेमचंद बैरवा की नियुक्ति को चुनौती दी है। सोलंकी का कहना है कि संविधान में उपमुख्यमंत्री का कोई पद ही नहीं है तो इस पद की शपथ कैसे ले ली गई? याचिका पर सुनावाई की तारीख आगामी दिनों में तय होगी।

यह कानूनी तौर पर गलत, इसलिए लगाई याचिका
दीया कुमारी और डॉ. प्रेमचंद बैरवा की नियुक्ति को चुनौती देने वाले एडवोकेट ओमप्रकाश सोलंकी का कहना है कि संविधान में डिप्टी सीएम के पद का कोई प्रावधान ही नहीं है। इसके बावजूद भी राजस्थान में दीया कुमारी और डॉ. प्रेमचंद बैरवा ने डिप्टी सीएम के नाम शपथ ले ली। यह कानूनी तौर पर गलत है। सोलंकी ने कहा कि जिस पद का संविधान में उल्लेख ही नहीं है, उस पद की शपथ कैसे ली जा सकती है। डिप्टी सीएम राजनैतिक पद हो सकता है लेकिन संवैधानिक पद नहीं है। ऐसे में माननीय उच्च न्यायालय में याचिका लगाकर दीया कुमारी और डॉ. प्रेमचंद बैरवा की नियुक्ति रद्द करने की मांग की गई है।

पहले की सरकारों में बनते रहे हैं डिप्टी सीएम
उपमुख्यमंत्री पद की शपथ का यह कोई पहला मामला नहीं है। हाल ही में मध्यप्रदेश और छत्तीसगढ़ में भी उप मुख्यमंत्री पद की शपथ ली गई। छह महीने पहले कर्नाटक में कांग्रेस की सरकार बनी। वहां डीके शिवकुमार को उपमुख्यमंत्री पद की शपथ दिलाई गई। राजस्थान में पूर्ववर्ती सरकारों में भी डिप्टी सीएम बनते रहे लेकिन तब डिप्टी सीएम के स्थान पर कैबिनेट मंत्री पद की शपथ ली जाती रही। 

निवर्तमान कांग्रेस सरकार में सचिन पायलट डिप्टी सीएम बने थे लेकिन उन्हें कैबिनेट मंत्री पद की शपथ दिलाई गई थी। इससे पहले भैरोंसिंह शेखावत सरकार में भी हरिशंकर भाभड़ा डिप्टी सीएम बने थे। पूर्ववर्ती गहलोत सरकार में डॉ. कमला बेनीवाल और बनवारी लाल बैरवा को भी उपमुख्यमंत्री बनाया गया था लेकिन उन्हें डिप्टी सीएम के बजाय कैबिनेट मंत्री के रूप में शपथ दिलाई गई थी।

सुप्रीम कोर्ट में खारिज हो चुकी ऐसी याचिकाएं
उपमुख्यमंत्री पद को चुनौती देने के संबंध में पहले भी अलग-अलग राज्यों में याचिकाएं दाखिल हुईं। ये याचिकाएं सुप्रीम कोर्ट तक पहुंची। सुप्रीम कोर्ट ने इन याचिकाओं को खारिज कर दिया। इससे पहले कर्नाटक, पंजाब, हरियाणा और बॉम्बे हाईकोर्ट में भी इस तरह की याचिकाएं खारिज हो चुकी हैं। कोर्ट के मुताबिक संविधान के अनुच्छेद 164(3) के तहत डिप्टी सीएम पद की शपथ दिलाई जा सकती है। ऐसा करना संविधान के प्रावधानों का उल्लंघन नहीं है।

Controversies have started as soon as the new government is formed in Rajasthan. On Friday, December 15, along with Bhajan Lal Sharma taking oath as Chief Minister, Diya Kumari and Dr. Premchand Bairwa took oath as Deputy Chief Ministers. The controversy started only after both the Deputy CMs took oath. Advocate Omprakash Solanki has challenged the appointment of Diya Kumari and Dr. Premchand Bairwa by filing a petition in the Rajasthan High Court. Solanki says that there is no post of Deputy Chief Minister in the Constitution, so how was the oath taken for this post? The date of hearing on the petition will be decided in the coming days.

This is legally wrong, hence the petition was filed
Advocate Omprakash Solanki, who challenged the appointment of Diya Kumari and Dr. Premchand Bairwa, says that there is no provision for the post of Deputy CM in the Constitution. Despite this, Diya Kumari and Dr. Premchand Bairwa took oath as Deputy CM in Rajasthan. This is legally wrong. Solanki said that how can the oath be taken for a post which is not mentioned in the Constitution. Deputy CM may be a political post but it is not a constitutional post. In such a situation, a petition has been filed in the Honorable High Court demanding cancellation of the appointment of Diya Kumari and Dr. Premchand Bairwa.

Deputy CMs have been made in previous governments
This is not the first case of oath taking as Deputy Chief Minister. Recently, oath for the post of Deputy Chief Minister was also taken in Madhya Pradesh and Chhattisgarh. Six months ago, Congress government was formed in Karnataka. There DK Shivkumar was sworn in as Deputy Chief Minister. Even in the previous governments in Rajasthan, Deputy CMs were made, but then the oath of office of Cabinet Minister was taken in place of Deputy CM.

Sachin Pilot had become the Deputy CM in the outgoing Congress government but he was sworn in as a Cabinet Minister. Earlier, Harishankar Bhabhada had also become Deputy CM in Bhairon Singh Shekhawat government. In the previous Gehlot government, Dr. Kamla Beniwal and Banwari Lal Bairwa were also made Deputy Chief Ministers but they were sworn in as Cabinet Ministers instead of Deputy CMs.

Such petitions have been rejected in the Supreme Court
Earlier too, petitions were filed in different states regarding challenging the post of Deputy Chief Minister. These petitions reached the Supreme Court. The Supreme Court rejected these petitions. Earlier, such petitions have also been rejected in Karnataka, Punjab, Haryana and Bombay High Courts. According to the court, the oath for the post of Deputy CM can be administered under Article 164(3) of the Constitution. Doing so is not a violation of the provisions of the Constitution.
