भरतपुर। देश के चर्चित हत्याकांड में शुमार ‘कुम्हेर कांड’ के नाम से सुर्खियां बटोरने वाले मामले में न्यायालय ने शनिवार को 31 साल बाद अपना फैसला सुनाया। इसमें 9 आरोपियों को दोषी मानते हुए आजीवन कारावास की सजा से दंडित किया है। साक्ष्य के अभाव में न्यायालय ने 41 आरोपियों को बरी कर दिया।
विशिष्ठ न्यायाधीश अनुसूचित जाति/जनजाति अत्याचार निवारण प्रकरण गिरिजा भारद्वाज ने मामले की सुनवाई की। इसमें सीबीआई की ओर से 83 लोगों को आरोपी बनाया गया था। इससे पहले सब इंस्पेक्टर कुम्हेर ने इस मामले में 37 जनों के खिलाफ रिपोर्ट दर्ज कराई थी। इसमें उल्लेख किया था कि 6 जून 1992 को बड़ा मोहल्ला कुम्हेर के दो जाति विशेष के लोगों में तनाव हो गया। इसके बाद करीब पांच से छह हजार की भीड़ हथियारों से लैस होकर पेंगोर की ओर से बिजली घर चौराहे की ओर आई तथा बड़ा मोहल्ला की ओर बढ़ गई।
भीड़ ने मकान तथा बिटौरा में रखें ईंधन में आग लगा दी। भीड़ ने पुलिस पर भी फायरिंग की थी। भीड़ को काबू में करने के लिए पुलिस ने करीब 30 राउंड फायर किए थे। बड़ा मोहल्ला, नाहरगंज डीग गेट व सेढ़ का मढ़ मोहल्ले में आगजनी की घटना से एक जाति के 50-60 घर पूर्ण रूप से जल गए तथा करीब 200 घर आंशिक रूप से जल गए। इसमें दो महिलाओं समेत सात लोगों की मौत हो गई तथा अन्य घायल हो गए।
बाद में 16 लोगों की मौत और 45 लोगों के घायल होने की पुष्टि हुई। इसके बाद यह मामला 26 जून 1992 को सीबीआई को सौंपा गया। सीबीआई ने इसमें कुल 83 लोगों को आरोपी बनाया था। मामले के कोर्ट में विचाराधीन होने के दौरान 32 लोगों की मौत हो गई, जबकि एक मफरूर चल रहा है। अब न्यायालय ने 9 आरोपियों को उम्रकैद की सजा सुनाते हुए 41 जनों को साक्ष्य के अभाव में बरी कर दिया।

न्यायालय ने लक्खो पुत्र राम सिंह, पारस जैन पुत्र माणकमल जैन, प्रेम सिंह पुत्र वेदो, चेतन पुत्र जय सिंह, मान सिंह पुत्र भंवर सिंह, शिव सिंह पुत्र राम सिंह, राजवीर पुत्र फौदी, पीतम पुत्र गिर्राज और गोपाल को आजीवन कारावास की सजा सुनाते हुए इन पर अर्थदंड भी लगाया है। 31 साल तक चले इस मामले में कुल 283 गवाह पेश किए गए थे।
हाइकोर्ट में अपील को 30 दिन का समय
न्यायालय एससी एसटी ने प्रकरण में नामजद नौ आरोपियों को उम्रकैद की सजा से दंडित किया है। अब आरोपी हाईकोर्ट में इस फैसले के खिलाफ अपील कर सकते हैं। इसकी अवधि 30 दिन की रहेगी।

Earlier, Sub Inspector Kumher had filed a report against 37 people in this case. It was mentioned in it that on June 6, 1992, there was tension between people of two particular castes of Bada Mohalla Kumher. After this, a crowd of about five to six thousand, armed with weapons, came towards the power house intersection from Pengor side and moved towards Bada Mohalla.
The mob set fire to the house and the fuel kept in Bitora. The mob also fired on the police. To control the crowd, the police fired about 30 rounds. Due to arson incident in Bada Mohalla, Naharganj Deeg Gate and Sedh Ka Madh Mohalla, 50-60 houses of one caste were completely burnt and about 200 houses were partially burnt. In this, seven people including two women died and others were injured.
Later, 16 people were confirmed dead and 45 injured. After this the case was handed over to CBI on 26 June 1992. CBI had made a total of 83 people accused in this. 32 people died while the case was pending in court, while one is on trial. Now the court sentenced 9 accused to life imprisonment and acquitted 41 people due to lack of evidence.

The court sentenced life imprisonment to Lakho son of Ram Singh, Paras Jain son of Mankamal Jain, Prem Singh son of Vedo, Chetan son of Jai Singh, Man Singh son of Bhanwar Singh, Shiv Singh son of Ram Singh, Rajveer son of Faudi, Pitam son of Girraj and Gopal. Fine has also been imposed on them. A total of 283 witnesses were presented in this case that lasted for 31 years.
30 days time to appeal in High Court
The SC/ST court has sentenced nine accused named in the case to life imprisonment. Now the accused can appeal against this decision in the High Court. Its duration will be 30 days.
