लोकसभा में आपराधिक कानून संशोधन से जुड़े तीन बिल पास

औपनिवेशक युग के आपराधिक कनूनों की जगह लाए गए तीन विधेयक बुधवार (20 दिसंबर) को लोकसभा में ध्वनिमत से पास हो गए. भारतीय न्याय (द्वितीय) संहिता 2023, भारतीय नागरिक सुरक्षा (द्वितीय) 2023 और भारतीय साक्ष्य (द्वितीय) विधेयक 2023 केंद्रीय गृहमंत्री अमित शाह ने सदन में पेश किए. ये तीनों विधेयक कानून बनने पर 1860 के भारतीय दंड संहिता (IPC), 1973 के आपराधिक प्रक्रिया संहिता (सीआरपीसी) और 1872 के भारतीय साक्ष्य अधिनियम की जगह लेंगे.

विधेयक पेश करते हुए अमित शाह ने इनकी विशेषताएं गिनाईं और बताया कि नया कानून पुराने से कितना ज्यादा बेहतर है. उन्होंने कहा कि पहले के कानूनों के तहत ब्रिटिश राज की सलामती प्राथमिकता थी, लेकिन अब मानव सुरक्षा और देश की सुरक्षा को प्राथमिकता दी गई है. आइए जानते हैं केंद्र सरकार की ओर से लए गए नए विधेयकों में क्या-क्या है और कानून बनने के बाद अपराध और अपराधियों पर कैसे लगाम कसी जाएगी- 

एफआईआर के लिए समयीमा तय
बिल में पुलिस के लिए खास दिशा-निर्देश हैं. इसके मुताबिक, घटना के बाद तीन दिन के अंदर एफआईआर दर्ज करनी होगी और 14 दिन के अंदर प्रारंभिक जांच हो जानी चाहिए. इसके बाद 24 दिन के अंदर-अंदर मजिस्ट्रेट के पास रिपोर्ट पहुंच जाए और आरोप पत्र दाखिल करने में 180 दिनों से ज्यादा की देरी नहीं होनी चाहिए.

 अगर जांच लंबित है तो कोर्ट से विशेष अनुमित लेनी होगी. उन्होंने यह भी कहा कि ऐसे गंभीर अपराध, जिनमें 3 से सात साल या उससे ज्यादा सजा का प्रावधान है. ऐसे अपराधों के लिए भी यही सख्त टाइमलाइन फॉलो की जानी चाहिए. एफआईआर दर्ज कर पुलिस 14 दिनों के अंदर प्रारंभिक जांच पूरी कर ले.

तय समसयसीमा में दाखिल होगी चार्जशीट
अमित शाह ने यह भी बताया कि नए कानून में चार्जशीट दाखिल किए जाने के लिए भी सख्त निर्देश हैं कि पुलिस को निर्धारित समय के अंतर्गत इस प्रक्रिया को पूरा करना होगा. अगर दोबारा जांच की जरूरत होती है तो कोर्ट से अनुमति लेनी होगी. उन्होंने कहा कि पुराने नियम में 60-90 दिन के अंदर चार्जशीट दाखिल करनी होती थी, लेकिन री-इंवेस्टिगेशन के कारण इसमें देरी हो जाती थी.

मॉब लिंचिंग पर फांसी की सजा का प्रावधान
अमित शाह ने लोकसभा में कहा कि सरकार राजद्रोह को देशद्रोह में बदलने जा रही है. वहीं, मॉब लिंचिंग पर मौत की सजा के प्रावधान की भी बात कही. उन्होंने कहा कि मॉब लिंचिंग घृणित अपराध है और नए कानून में इस अपराध के लिए फांसी की सजा का प्रावधान किया जा रहा है.

महिलाओं के लिए ई-एफआईआर
बिल में महिलाओ के लिए ई-एफआईआर की सुविधा का प्रस्ताव दिया गया है. जो महिलाएं शिकायत दर्ज कराने के लिए पुलिस स्टेशन नहीं जाना चाहती हैं उनके लिए ई-एफआईआर की सुविधा उपलब्ध होगी और 24 घंटे के अंदर पुलिस खुद उनके पास पहुंच जाएगी. 

इसके अलावा, ऐसे अपराध जिनके लिए 7 साल या उससे ज्यादा की सजा का प्रावधान है, उनमें दोषसिद्धी के लिए फोरेंसिक जांच जरूरी होगी. गवाहों की सुरक्षा को भी नए बिल में शामिल किया गया है और इसके लिए इलेक्ट्रॉनिक मोड में सुबूत इकट्ठा करने और बयान रिकॉर्ड करने की अनुमति होगी.

अनुपस्थिति में ट्रायल
नया विधेयक अभियुक्त की अनुपस्थिति में सुनवाई का प्रावधान पेश करता है. अमित शाह ने कहा, 'नए प्रावधान से भारत में कानूनी प्रक्रिया से बचने वाले सभी भगोड़ों के खिलाफ उनकी अनुपस्थिति में भी कार्रवाई की जा सकती है. इससे तुरंत न्याय सुनिश्चित करने में मदद मिलेगी और ऐसे भगोड़ों को देश में वापस लाने की प्रक्रिया में भी तेजी आएगी. 

उन्होंने कहा कि मुंबई ब्लास्ट जैसे कई मामलों ने देश को झकझोरा है, लेकिन आरोपी दूसरे देशों में छिपे हुए हैं और उन पर मुकदमा नहीं चल रहा है. इन पर कार्रवाई के लिए आरोपी अगर कोर्ट में पेश नहीं भी होगा तो मुकदमा चलाया जाएगा. अगर आरोपी 90 दिनों के भीतर अदालत में पेश नहीं होते हैं तो उनकी अनुपस्थिति में भी मुकदमा चलेगा. उनके अभियोजन के लिए एक सरकारी वकील नियुक्त किया जाएगा. इससे भगोड़ों को वापस लाने की प्रक्रिया तेज हो जाएगी.'

झूठ बोलकर संबंध बनाने वालों की भी खैर नहीं
गृह मंत्री अमित शाह ने कहा कि झूठ बोलकर शादी संबंध बनाने वालों के लिए नया प्रावधान लाया गया है. अपनी पहचान छिपाकर झूठा बहाना बनाकर किसी के साथ संबंध बनाने वाले किसी भी व्यक्ति को बख्शा नहीं जाएगा.

Three bills that replaced colonial-era criminal laws were passed by voice vote in the Lok Sabha on Wednesday (20 December). Indian Justice (Second) Code 2023, Indian Civil Defense (Second) 2023 and Indian Evidence (Second) Bill 2023 were introduced in the House by Union Home Minister Amit Shah. If these three bills become law, they will replace the Indian Penal Code (IPC) of 1860, the Code of Criminal Procedure (CrPC) of 1973 and the Indian Evidence Act of 1872.

While presenting the bill, Amit Shah enumerated its features and told how much better the new law is than the old one. He said that under the earlier laws, the safety of the British Raj was the priority, but now human safety and the security of the country have been given priority. Time limit fixed for FIR
There are special guidelines for the police in the bill. According to this, FIR has to be registered within three days after the incident and preliminary investigation should be done within 14 days. After this, the report should reach the magistrate within 24 days and there should not be a delay of more than 180 days in filing the charge sheet.

  If investigation is pending then special permission will have to be taken from the court. He also said that such serious crimes, in which there is a provision of punishment of 3 to seven years or more. The same strict timeline should be followed for such crimes also. After registering the FIR, the police should complete the preliminary investigation within 14 days.

Charge sheet will be filed within the stipulated time limit
Amit Shah also said that there are strict instructions in the new law for filing chargesheet that the police will have to complete this process within the stipulated time. If there is a need for re-investigation, permission will have to be taken from the court. He said that under the old rule, charge sheet had to be filed within 60-90 days, but it got delayed due to re-investigation.

Provision for death penalty for mob lynching
Amit Shah said in Lok Sabha that the government is going to convert treason into treason. At the same time, he also talked about the provision of death penalty for mob lynching. He said that mob lynching is a heinous crime and in the new law, a provision for death penalty is being made for this crime.

E-FIR for women
The bill has proposed the facility of e-FIR for women. The facility of e-FIR will be available for those women who do not want to go to the police station to lodge a complaint and the police will themselves reach them within 24 hours.

Apart from this, forensic investigation will be necessary for conviction in crimes for which there is a provision of punishment of 7 years or more. Protection of witnesses has also been included in the new bill and for this, collecting evidence and recording statements will be allowed in electronic mode.

trial in absentia
The new bill introduces the provision of trial in the absence of the accused. Amit Shah said, 'With the new provision, action can be taken against all fugitives who escape legal process in India even in their absence. This will help in ensuring prompt justice and will also speed up the process of bringing such fugitives back to the country.

He said that many cases like Mumbai blasts have shocked the country, but the accused are hiding in other countries and they are not being prosecuted. Even if the accused does not appear in the court for action against them, a case will be prosecuted. If the accused do not appear in the court within 90 days, the trial will continue in their absence. A public prosecutor will be appointed for his prosecution. This will speed up the process of bringing back the fugitives.

There is no good for those who establish relationships by lying.
Home Minister Amit Shah said that a new provision has been brought for those who enter into marriage by lying. Any person who conceals his identity and has a relationship with someone under false pretenses will not be spared.
