SI भर्ती 2021 पेपर लीक में गिरफ्तार 11 ट्रेनी थानेदारों को झटका, हाईकोर्ट ने दिया मुश्किल बढ़ाने वाला फैसला

जयपुर: सब इंस्पेक्टर भर्ती परीक्षा 2021 के पेपर लीक मामले में जिन 11 ट्रेन एसआई को निचली कोर्ट ने जमानत दी थी। उन ट्रेनी एसआई की जमानत राजस्थान हाईकोर्ट ने खारिज कर दी है। निचली कोर्ट ने आरोपी ट्रेनी सब इंस्पेक्टर को एसओजी की ओर से अवैध हिरासत में रखे जाने की दलील को मानते हुए जमानत स्वीकार की थी। निचली अदालत के इस फैसले के विरुद्ध एसओजी ने राजस्थान हाईकोर्ट में याचिका लगा दी थी। बुधवार 8 मई को इस याचिका की सुनवाई करते हुए हाईकोर्ट ने निचली कोर्ट के फैसले को रद्द कर दिया। हाईकोर्ट ने कहा कि एसओजी ने इन 11 ट्रेनी एसआई को अवैध हिरासत में रखा या नहीं। इस बारे डीजीपी फैसला करें। डीजीपी की रिपोर्ट आने से पहले अवैध हिरासत मानते हुए जमानत देना उचित नहीं है।

सुप्रीम कोर्ट तक पहुंचा था जमानत का मामला
पेपर लीक के मामले में गिरफ्तार किए गए ट्रेनी सब इंस्पेक्टर्स को जयपुर मेट्रो-द्वितीय की सीएमएम कोर्ट ने 11 ट्रेनी एसआई और एक कॉन्स्टेबल को 12 अप्रैल को जमानत पर रिहा करने के आदेश दिए थे। एसओजी के प्रार्थना पत्र की सुनवाई करते हुए हाईकोर्ट ने जयपुर मेट्रो द्वितीय के इस फैसले पर 15 अप्रैल को अंतरिम रोक लगा दी थी। इस रोक के विरुद्ध आरोपी सुप्रीम कोर्ट पहुंचे थे। सुप्रीम कोर्ट ने हाईकोर्ट को एक सप्ताह में मामले की सुनवाई पूरी करने के आदेश दिए थे। बुधवार को जस्टिस सुदेश बंसल की अदालत ने सीएमएम कोर्ट के आदेश को रद्द करते हुए कहा कि जब कोर्ट ने पहले से गिरफ्तार 14 आरोपियों के संबंध में तथ्य जांचने के लिए डीजीपी को निर्देश दिए थे, तो उस रिपोर्ट के आने से पहले कोर्ट को इन आरोपियों को लेकर डिफरेंट व्यू लेने की कोई आवश्यकता नहीं थी।

स्वतंत्र रूप से बैरक में रखना अवैध हिरासत नहीं
राजस्थान हाईकोर्ट में एसओजी की ओर से विशिष्ठ लोक अभियोजक (एसपीपी) अनुराग शर्मा ने पक्ष रखा। शर्मा ने कोर्ट में कहा कि 2 अप्रैल को आरपीए से लाने के बाद सभी आरोपियों को स्वतंत्र रूप से एसओजी के बैरकों में रखा गया था। जहां एसओजी के कर्मचारी रहते हैं। बैरक में स्वतंत्र रूप से रखना अवैध हिरासत नहीं माना जा सकता। पूछताछ के बाद सभी आरोपियों को कानूनी रूप से गिरफ्तार किया हैं। आरोपियों को 3 अप्रैल को गिरफ्तार किया था और 24 घंटे के अंदर कोर्ट में पेश कर दिया था।

आरोपियों के वकील ने कहा अवैध हिरासत में रखा था
आरोपियों की ओर से पैरवी करते हुए एडवोकेट रमित पारीक और वेदांत शर्मा ने कहा कि एसओजी जब आरोपियों को आरपीए से लेकर गई थी। उसी समय से इनकी गिरफ्तारी मानी जाएगी। क्योंकि गिरफ्तारी की परिभाषा के अनुसार जब एजेंसी किसी व्यक्ति को जबरन डिटेन करे, अथवा एजेंसी के कहने पर व्यक्ति अपनी कस्टडी सौंप दे। दोनों ही सूरत में यह गिरफ्तारी की परिभाषा में आएगा।

कई ट्रेनी सब इंस्पेक्टर हो चुके गिरफ्तार
एसओजी ने पेपर लीक मामले में दो दर्जन से ज्यादा ट्रेनी सब इंस्पेक्टर को गिरफ्तार किया। इनमें सब इंस्पेक्टर भर्ती 2021 का टॉपर नरेश खिलेरी और कई महिला सब इंस्पेक्टर भी शामिल है। एसओजी ने पेपर लीक करने वाले जगदीश बिश्नोई और जिस स्कूल से पेपर लीक किए गए। उस स्कूल के संचालक को भी गिरफ्तार किया। जोधपुर कमिश्नरेट के सदर बाजार थाने में तैनात एक कांस्टेबल अभिषेक बिश्नोई को भी एसओजी ने गिरफ्तार किया था।

The bail of that trainee SI has been rejected by the Rajasthan High Court. The lower court had accepted the bail of the accused Trainee Sub Inspector considering the plea of SOG that he was being kept in illegal custody. SOG had filed a petition in the Rajasthan High Court against this decision of the lower court. While hearing this petition on Wednesday, May 8, the High Court canceled the decision of the lower court. The High Court asked whether SOG kept these 11 trainee SIs in illegal custody or not. DGP should decide in this regard. It is not appropriate to grant bail considering illegal detention before the DGP report comes.

The bail matter had reached the Supreme Court
The CMM Court of Jaipur Metro-II had ordered the release of 11 trainee SIs and one constable on bail on April 12, along with the trainee sub-inspectors arrested in the paper leak case. While hearing the application of SOG, the High Court had put an interim stay on this decision of Jaipur Metro II on April 15. The accused had reached the Supreme Court against this ban. The Supreme Court had ordered the High Court to complete the hearing of the case in a week. On Wednesday, the court of Justice Sudesh Bansal, while canceling the order of the CMM Court, said that when the court had directed the DGP to investigate the facts regarding the 14 already arrested accused, before the report came, the court had to take action against these accused. There was no need to take a different view regarding this.

Keeping in barrack freely is not illegal detention
Special Public Prosecutor (SPP) Anurag Sharma presented the case on behalf of SOG in Rajasthan High Court. Sharma told the court that after being brought from RPA on April 2, all the accused were kept independently in the SOG barracks. Where SOG employees live. Keeping them free in the barrack cannot be considered as illegal detention. After interrogation, all the accused have been arrested legally. The accused were arrested on April 3 and presented in the court within 24 hours.

The lawyer of the accused said that he was kept in illegal custody.
Advocates Ramit Pareek and Vedant Sharma, appearing on behalf of the accused, said that when SOG took the accused from RPA. From that moment onwards they will be considered arrested. Because according to the definition of arrest, when the agency forcibly detains a person, or the person surrenders his custody on the request of the agency. In both the cases it would fall within the definition of arrest.

Many trainee sub inspectors have been arrested
SOG arrested more than two dozen trainee sub-inspectors in the paper leak case. These include Sub Inspector Recruitment 2021 topper Naresh Khileri and many women sub inspectors. SOG has arrested Jagdish Bishnoi who leaked the paper and the school from where the papers were leaked. The director of that school was also arrested. Abhishek Bishnoi, a constable posted at Sadar Bazar police station of Jodhpur Commissionerate, was also arrested by the SOG.
