WhatsApp: 'भारत छोड़कर चले जाएंगे', व्हाट्सएप ने क्यों दी धमकी? सरकार के किस फैसले से नाराज है

सोशल मीडिया प्लेटफॉर्म वॉट्सऐप ने कहा है कि अगर उसे एन्क्रिप्शन तोड़ने के लिए मजबूर किया जाता है, तो वह भारत में अपना काम बंद कर देगा और यहां से चला जाएगा. मेटा के स्वामित्व वाले मैसेजिंग प्लेटफॉर्म वॉट्सऐप की तरफ से पेश वकील ने दिल्ली हाईकोर्ट में ये दलील रखी है. वकील ने कहा कि लोग वॉट्सऐप का इस्तेमाल इसकी प्राइवेसी की खूबी के लिए करते हैं. वे जानते हैं कि इस पर भेजे जाने वाले मैसेज एंड-टू-एंड एन्क्रिप्टेड होते हैं.

दरअसल, वॉट्सऐप और इसकी पैरेंट कंपनी मेटा ने 2021 में देश में लाए गए इंफोर्मेशन टेक्नोलॉजी (आईटी) नियमों को दिल्ली हाईकोर्ट में चुनौती दी है. हाईकोर्ट में गुरुवार (25 अप्रैल) को दोनों की याचिकाओं पर सुनवाई हुई. आईटी नियमों में कहा गया है कि सोशल मीडिया मैसेजिंग कंपनियों के लिए किसी चैट का पता लगाने और मैसेज को सबसे पहले क्रिएट करने वाले शख्स का पता लगाने के लिए प्रावधान करना जरूरी होगा. मेटा के सीईओ मार्क जुबरबर्ग हैं.

कब लागू हुए आईटी नियम?
केंद्र सरकार ने 25 फरवरी, 2021 को 'इंफोर्मेशन टेक्नोलॉजी' (इंटरमीडियरी गाइडलाइंस एंड डिजिटल मीडिया एथिक्स कोड) रूल्स, 2021 का ऐलान किया था. इसमें कहा गया है कि ट्विटर (अब एक्स), फेसबुक, इंस्टाग्राम और वॉट्सऐप जैसे बड़े सोशल मीडिया प्लेटफार्मों को नए नियमों को मानना होगा. इसमें कहा गया कि कंपनियों को प्राइवेसी पॉलिसी का ध्यान रखना होगा. साथ ही ऐसे प्रयास करने होंगे, जिनके जरिए यूजर्स प्रतिबंधित कंटेट को न तो बना पाएं और न ही अपलोड कर पाएं.

वॉट्सऐप ने भारत छोड़ने की बात कही
बार एंड बेंच की रिपोर्ट के मुताबिक, वॉट्सऐप की तरफ से दिल्ली हाईकोर्ट में वकील तेजस कारिया पेश हुए. उन्होंने कार्यवाहक चीफ जस्टिस मनमोहन और जस्टिस मनमीत प्रीतम सिंह अरोड़ा की पीठ से कहा, "एक प्लेटफॉर्म के तौर पर हम कह रहे हैं कि अगर हमें एन्क्रिप्शन तोड़ने के लिए कहा जाता है, तो हम यहां से चले जाएंगे."

कंपनी की परेशानी बताते हुए वकील ने कहा, "हमें मैसेजों की एक पूरी चेन तैयार रखनी होगी. हमें नहीं पता है कि कौन से मैसेज को डिक्रिप्ट करने के लिए कह दिया जाए. इसका मतलब हुआ कि लाखों-करोड़ों मैसेजों को कई सालों तक स्टोर करके रखना पड़ेगा."

हाईकोर्ट में सुनवाई के दौरान पीठ ने माना कि इस मामले पर सभी पक्षों को बहस करना होगा. अदालत ने सवाल किया कि क्या किसी अन्य देश में भी इस तरह (आईटी नियमों) का कानून मौजूद है? इस पर वकील ने कहा, "दुनिया में कहीं भी इस तरह का नियम नहीं है. यहां तक कि ब्राजील में भी ऐसा कोई नियम मौजूद नहीं है." कोर्ट ने आगे कहा कि गोपनीयता का अधिकार पूर्ण नहीं है और कहीं न कहीं संतुलन बनाने की जरूरत है.

सरकार ने बताया क्यों जरूरी है आईटी नियम?
वहीं, केंद्र सरकार की ओर से पेश वकील ने कहा कि सांप्रदायिक हिंसा जैसे मामलों में आपत्तिजनक कंटेट प्लेटफॉर्म पर फैलाया जाता है, इसलिए आईटी नियम जरूरी हो जाता है. हाईकोर्ट की पीठ ने कहा कि इस मामले पर 14 अगस्त को सुनवाई होगी, ताकि सुप्रीम कोर्ट के आदेश के अनुसार आईटी नियमों के कई पहलुओं को चुनौती देने वाली अन्य सभी याचिकाएं उसके पास ट्रांसफर हो जाएं.

क्या होता है एन्क्रिप्शन?
वॉट्सऐप की ऑफिशियल वेबसाइट पर दी गई जानकारी के मुताबिक, ये मैसेजिंग प्लेटफॉर्म सभी पर्सनल मैसेजों पर एंड-टू-एंड एन्क्रिप्शन की सुविधा देता है. आसान भाषा में कहें तो अगर कोई व्यक्ति किसी अन्य शख्स को मैसेज भेजता है या फिर उसका मैसेज रिसीव करता है, तो ये जानकारी सिर्फ उन दोनों के पास ही रहती है. कोई भी तीसरा व्यक्ति दो लोगों के बीच हुए मैसेज को पढ़ या सुन नहीं सकता है. ये वॉट्सऐप समेत कई मैसेजिंग एप्स के सबसे जरूरी फीचर हैं.

In fact, WhatsApp and its parent company Meta have challenged the Information Technology (IT) rules brought in the country in 2021 in the Delhi High Court. The petitions of both were heard in the High Court on Thursday (April 25). IT rules state that it will be necessary for social media messaging companies to make provisions to trace a chat and trace the person who first created the message. The CEO of Meta is Mark Zuberberg.

When did IT rules come into effect?
The Central Government had announced the 'Information Technology' (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 on February 25, 2021. It says that big social media platforms like Twitter (now X), Facebook, Instagram and WhatsApp will have to follow the new rules. It was said that companies will have to take care of the privacy policy. Also, such efforts will have to be made through which users are neither able to create nor upload restricted content.

WhatsApp talked about leaving India
According to the report of Bar and Bench, lawyer Tejas Karia appeared in the Delhi High Court on behalf of WhatsApp. "As a platform, we are saying that if we are asked to break encryption, we will leave," he told a bench of Acting Chief Justice Manmohan Singh and Justice Manmeet Pritam Singh Arora.

Explaining the company's problem, the lawyer said, "We have to keep a complete chain of messages ready. We do not know which messages will be asked to be decrypted. This means that millions and crores of messages will have to be stored for many years. We will have to do it."

There are no rules like IT rules anywhere in the world: WhatsApp lawyer
During the hearing in the High Court, the bench accepted that all the parties will have to debate this matter. The court questioned whether such a law (IT rules) exists in any other country? To this the lawyer said, "There is no such rule anywhere in the world. Even in Brazil, no such rule exists." The court further said that the right to privacy is not absolute and a balance needs to be struck somewhere.

Government told why IT rules are necessary?
At the same time, the lawyer appearing for the Central Government said that in cases like communal violence, objectionable content is spread on the platform, hence IT rules become necessary. The High Court bench said that the matter will be heard on August 14, so that as per the order of the Supreme Court, all other petitions challenging various aspects of the IT rules are transferred to it.

What is encryption?
According to the information given on the official website of WhatsApp, this messaging platform provides end-to-end encryption on all personal messages. In simple language, if a person sends a message to another person or receives a message from that person, then this information remains only with both of them. No third person can read or listen to the messages between two people. These are the most important features of many messaging apps including WhatsApp.
