खतरनाक कुत्तों को पालने पर केंद्र सरकार ने लगाई थी रोक, हाईकोर्ट ने सरकार के आदेश को पलटा, नोटिस भेज मांगा जवाब

केंद्र सरकार के संयुक्त सचिव भारत सरकार मत्स्य पालन पशुपालन और डेयरी मंत्रालय नई दिल्ली की ओर से सभी राज्य सरकार को परिपत्र जारी करते हुए डॉग की कुछ नस्लों को मानव जीवन के लिए खतरनाक बताकर प्रतिबंध लगाते हुए एक परिपत्र 12 मार्च 2024 को जारी किया था.

इस मामले में राजस्थान हाई कोर्ट में जस्टिस नूपुर भाटी ने केंद्र सरकार सयुंक्त सचिव  की ओर से खतरनाक डॉग पर प्रतिबंध लगाने के लिए राज्य सरकारों को जारी इस परिपत्र पर रोक लगा दी है. हाई कोर्ट ने परिपत्र को राजस्थान में लागू करने पर रोक लगाते हुए केंद्र और राज्य सरकार को नोटिस जारी करते हुए जवाब तलब किया है.

याचिकाकर्ता ने केंद्र के परिपत्र को दी चुनौती
जोधपुर निवासी अश्वनी देवल की ओर से याचिका पेश करते हुए केंद्र सरकार के परिपत्र को चुनौती दी गई. याचिकाकर्ता की ओर से अधिवक्ता ऋषभ पुरोहित ने याचिका पेश करते हुए बताया, कि याचिकाकर्ता एक डॉग ट्रेनर है. 12 मार्च 2024 को केंद्र सरकार के संयुक्त सचिव द्वारा सभी राज्य सरकार को परिपत्र जारी करते हुए, डॉग की कुछ नस्लों को मानव जीवन के लिए खतरनाक बताते हुए इनपर प्रतिबंध लगा दिया है. 

वहीं केंद्र सरकार के इस परिपत्र पर कोलकाता और कर्नाटक हाईकोर्ट ने भी रोक लगा दी है. जिस पर हाईकोर्ट ने केंद्र और राज्य सरकार को नोटिस जारी करते हुए अगली तारीख तक केंद्र सरकार की ओर से जारी परिपत्र को राजस्थान राज्य में लागू करने पर रोक लगा दी है.

इन डॉग्स पर लगाई थी रोक
दरअसल केंद्र सरकार ने अपने परिपत्र में कहा था कि देश के कई क्षेत्रों से लोगों पर डॉग के अटैक करने की खबरें आ रही है और केंद्र सरकार ने ऐसे खतरनाक डॉग जैसे पिटबुल, रोटविलर, टेरियर, वोल्फ डॉग और मेस्टिफस डॉग शामिल है. केंद्र सरकार के संयुक्त सचिव द्वारा इनके आयात बिल्डिंग और खरीद फार्म पर रोक लगाने के लिए राज्यों को पत्र लिखकर कहा था की सरकार अपने राज्य में स्थानीय निकायों से बात करके इस पर प्रतिबंध लागू करवाए. ऐसे में जिन लोगों के पास पहले से इन प्रजाति के डॉग है. उनको भी स्टेरलाइजिंग करने पर जोर दिया गया ताकि वह ब्रीडिंग ना कर सके.

वहीं केंद्र सरकार के संयुक्त सचिव द्वारा जारी परिपत्र को लेकर याचिकाकर्ता ने बताया कि केंद्र सरकार के संयुक्त सचिव द्वारा जारी यह परिपत्र मनमाना है. और यदि इन डॉग्स को स्टेरलाइजिंग किया जाता है. तो वह डॉग के जीवन के लिए खतरा हो सकता है. और उन्हें कई प्रकार की बीमारियां भी हो सकती है याचिकाकर्ता के अधिवक्ता की दी गई दलीलों को सुनते हुए राजस्थान हाई कोर्ट ने नोटिस जारी करते हुए राजस्थान में इस परिपत्र को लागू करने पर रोक लगा दी है

Joint Secretary to the Central Government, Government of India, Ministry of Fisheries, Animal Husbandry and Dairying, New Delhi, issued a circular to all the state governments on March 12, 2024, banning some dog breeds as dangerous to human life.

In this case, Justice Nupur Bhati in Rajasthan High Court has put a stay on the circular issued by the Central Government Joint Secretary to the state governments to ban dangerous dogs. The High Court has issued a notice to the Central and State Governments and sought their response, prohibiting the implementation of the circular in Rajasthan.

Petitioner challenges Centre's circular
The Central Government's circular was challenged by presenting a petition on behalf of Jodhpur resident Ashwani Deval. While presenting the petition on behalf of the petitioner, advocate Rishabh Purohit said that the petitioner is a dog trainer. On March 12, 2024, the Joint Secretary of the Central Government issued a circular to all the state governments, banning some dog breeds, terming them dangerous to human life.

Kolkata and Karnataka High Court have also banned this circular of the Central Government. On which the High Court has issued a notice to the Central and State Governments and has banned the implementation of the circular issued by the Central Government in the state of Rajasthan till the next date.

These dogs were banned
In fact, the Central Government had said in its circular that there are reports of dog attacks on people from many areas of the country and the Central Government has included such dangerous dogs as Pitbull, Rottweiler, Terrier, Wolf Dog and Mastiff Dog. The Joint Secretary of the Central Government had written a letter to the states to ban their import, building and purchase forms and said that the government should talk to the local bodies in their states and get the ban implemented. In such a situation, people who already have dogs of this species. Emphasis was laid on sterilizing them so that they could not breed.

Concern was expressed about sterilizing
Regarding the circular issued by the Joint Secretary of the Central Government, the petitioner said that this circular issued by the Joint Secretary of the Central Government is arbitrary. And if these dogs are sterilized. So it could be a threat to the dog's life. And they may also suffer from many types of diseases. Hearing the arguments given by the petitioner's advocate, the Rajasthan High Court has issued a notice banning the implementation of this circular in Rajasthan.
