करौली जिले के हिंडौन कोर्ट का एक बड़ा मामला पिछले दो दिन से सुर्खियों में है। एक दुष्कर्म पीड़ित युवती ने पुरुष जज पर गंभीर आरोप लगाए हैं। पीड़िता का आरोप है कि 164 के बयान दर्ज करने के दौरान पुरुष जज ने उसे कपड़े उतारने के लिए कहा था। पीड़िता के मुताबिक कोर्ट में बयान दर्ज करने के दौरान उसे कहा गया कि वह अपनी पजामी और कुर्ती उतार कर शरीर पर लगी चोटें दिखाएं। पीड़िता की ओर से हिंडौन पुलिस उप अधीक्षक कार्यालय में एफआईआर दर्ज कराई गई है। हालांकि इस एफआईआर में जज का नाम नहीं लिखा है।
अकेले में बयान दर्ज हो रहे थे, उस दौरान की घटना
पीड़िता की ओर से दर्ज कराई गई रिपोर्ट में बताया गया है कि दुष्कर्म के मामले में वह कोर्ट में बयान दर्ज कराने गई थी। इस दौरान पीड़िता के साथ तीन व्यक्ति थे जिनमें एक पीड़िता की भाभी भी थी। बयान दर्ज करने के दौरान जज ने सिर्फ पीड़िता को ही कोर्ट में बुलाया जबकि कोर्ट के बाहर उनकी भाभी और तीन अन्य व्यक्ति खड़े थे। बयान दर्ज करने के दौरान पुरुष जज ने जब कपड़े उतार कर शरीर पर लगी चोटें दिखाने की बात कही तो पीड़िता असहज हो गई। उसने कहा कि वे उनके सामने कपड़े नहीं उतार सकती। किसी महिला को ही अपने शरीर पर लगी चोटें दिखा सकती है। पीड़िता के मुताबिक इस पर जज ने उसे बाहर जाने के लिए कह दिया।
विभागीय कार्रवाई होनी चाहिए - पूर्व जज पानाचंद जैन
न्यायिक सेवा से जुड़े गई जजों ने इस मामले को बड़ा गंभीर माना है। राजस्थान हाईकोर्ट के पूर्व पानाचंद जैन का कहना है कि हाईकोर्ट को इस मामले को गंभीरता से लेना चाहिए और अपने स्तर पर जांच कराई जानी चाहिए। जांच पूरी होने तक आरोपित जज को पद से हटा देना चाहिए। ऐसे मामलों में आरोपित के खिलाफ विभागीय कार्रवाई भी होनी चाहिए।
हाईकोर्ट प्रशासन की बनी दोहरी जिम्मेदारी
बार काउंसिल के वाइस चेयरमैन कपिल प्रताप माथुर का कहना है कि मामला अत्यधिक संवेदनशील है। ऐसे मामलों में न्यायपालिका के घेरे में आ जाता ही। इस प्रकरण में हाईकोर्ट प्रशासन की अब दोहरी जिम्मेदारी बन गई है। एक तो यह कि वे पीड़िता को न्याय दिलाए और दूसरा यह कि वे आरोपित के खिलाफ मामले की पूरी जांच करे। जांच में दोषी पाए जाएं तो जज के खिलाफ भी कार्रवाई हो।
हाईकोर्ट के सीजे की मंजूरी के बिना दर्ज नहीं हो सकती एफआईआर
पूर्व न्यायिक अधिकारी और राजस्थान हाईकोर्ट से सीनियर एडवोकेट एके जैन का कहना है कि हाईकोर्ट के मुख्य न्यायाधीश की अनुमति के बिना किसी भी जज के खिलाफ एफआईआर दर्ज नहीं की जा सकती। सुप्रीम कोर्ट भी यूपी ज्यूडिशियल ऑफिसर्स एसोसिएशन बनाम केंद्र सरकार और अन्य के मामलों में ऐसे फैसले सुना चुका है। जो मामला सामने आया है। उसमें भी पहले हाईकोर्ट प्रशासन अपने स्तर पर जांच करेगा। पुलिस कार्रवाई उसके बाद ही आगे बढ सकेगी।

While recording the statement, the victim became uncomfortable when the male judge asked her to remove her clothes and show the injuries on her body. She said that she could not take off her clothes in front of him. Only a woman can show the injuries on her body. According to the victim, on this the judge asked her to go out.
Departmental action should be taken - Former judge Panachand Jain
The judges associated with the judicial service have considered this matter very serious. Former Rajasthan High Court Panachand Jain says that the High Court should take this matter seriously and investigation should be conducted at its level. The accused judge should be removed from his post until the investigation is completed. In such cases, departmental action should also be taken against the accused.
Double responsibility of High Court administration
Bar Council Vice Chairman Kapil Pratap Mathur says that the matter is highly sensitive. In such cases, he would have come under the scanner of the judiciary. The High Court administration has now become double responsible in this matter. Firstly, they should provide justice to the victim and secondly, they should thoroughly investigate the case against the accused. If found guilty in the investigation, action should be taken against the judge also.
FIR cannot be registered without the approval of the High Court CJ.
Former judicial officer and senior advocate from Rajasthan High Court, AK Jain, says that FIR cannot be registered against any judge without the permission of the Chief Justice of the High Court. The Supreme Court has also given such decisions in the cases of UP Judicial Officers Association vs Central Government and others. The matter which has come to light.
