बीकानेर। मोटरयान दुर्घटना दावा अधिकरण (MACT) बीकानेर ने एक महत्वपूर्ण आदेश जारी करते हुए सड़क दुर्घटना में मृतक आशाराम पुत्र भंवरलाल मेघवाल के परिजनों को 43,58,700 रुपये मय सात प्रतिशत वार्षिक ब्याज के साथ मुआवजा प्रदान करने का निर्देश दिया है। यह फैसला पीठासीन अधिकारी अनवर अहमद चौहान द्वारा दिया गया, जिसने पीड़ित परिवार को बड़ी राहत दी है।

यह दुर्घटना 28 जुलाई 2021 की रात करीब 9:30 से 10:00 बजे के बीच हुई थी। आशाराम मेघवाल अपनी मोटरसाइकिल से केला पेट्रोल पंप से बुकिंग लेकर कृष्णा पेट्रोल पंप, ऊन मंडी की ओर जा रहे थे। इसी दौरान शोभासर गांव से पहले पीछे से आ रहे एक ट्रक-ट्रेलर चालक ने तेज गति और लापरवाही से वाहन चलाते हुए उनकी मोटरसाइकिल को जोरदार टक्कर मार दी। टक्कर इतनी भीषण थी कि आशाराम गंभीर रूप से घायल हो गए और उन्हें तुरंत बीकानेर के पीबीएम अस्पताल के ट्रॉमा सेंटर पहुंचाया गया, जहां उपचार के दौरान उनकी मृत्यु हो गई।

दुर्घटना के बाद आशाराम के परिजनों ने मोटरयान दुर्घटना दावा अधिकरण में मुआवजे की याचिका लगाई। याचिकाकर्ताओं की ओर से एडवोकेट हेमन्त सिंह चौहान ने पैरवी की। उन्होंने अदालत में विस्तृत तर्क प्रस्तुत करते हुए साबित किया कि दुर्घटना ट्रक चालक की लापरवाही के कारण हुई, जिसके चलते आशाराम की समय से पहले मौत हो गई। आशाराम का परिवार आर्थिक रूप से उन्हीं पर निर्भर था, इसलिए उनका निधन परिवार के लिए भारी आघात बनकर आया।

अदालत ने सभी साक्ष्यों, पोस्टमॉर्टम रिपोर्ट, पुलिस केस, गवाहों के बयान और दुर्घटना की परिस्थितियों पर विचार कर पाया कि ट्रक चालक की गलती स्पष्ट रूप से साबित होती है। इसी आधार पर मोटरयान दुर्घटना दावा अधिकरण ने मृतक आशाराम मेघवाल के परिवार को कुल 43,58,700 रुपये का मुआवजा देने का आदेश दिया। साथ ही यह राशि 31 अक्टूबर 2021 से 7% वार्षिक ब्याज के साथ अदा करने के निर्देश भी दिए गए।

यह फैसला न केवल पीड़ित परिवार के लिए राहत लेकर आया है बल्कि सड़क दुर्घटना मामलों में न्यायालय की संवेदनशीलता और त्वरित न्याय की दिशा में एक महत्वपूर्ण उदाहरण भी प्रस्तुत करता है। बीकानेर में बढ़ते सड़क हादसों और लापरवाही से वाहन चलाने के बढ़ते मामलों को देखते हुए यह निर्णय जागरूकता का भी संदेश देता है।

The Motor Accident Claims Tribunal (MACT), Bikaner, has issued a significant order directing compensation of ₹43,58,700, along with seven percent annual interest, to the family of Asha Ram, son of Bhanwarlal Meghwal, who died in a road accident. This decision, delivered by Presiding Officer Anwar Ahmed Chauhan, provided significant relief to the victim's family.

The accident occurred between 9:30 and 10:00 pm on July 28, 2021. Asha Ram Meghwal, after booking a vehicle from Kela Petrol Pump, was traveling on his motorcycle to Krishna Petrol Pump, Wool Market. Just before Shobhasar village, a truck-trailer driver, driving recklessly and at high speed, struck his motorcycle. The impact was so severe that Asha Ram was seriously injured and was immediately rushed to the Trauma Center of PBM Hospital in Bikaner, where he died during treatment.

Following the accident, Asha Ram's family filed a compensation petition with the Motor Accident Claims Tribunal. Advocate Hemant Singh Chauhan represented the petitioners. He presented detailed arguments before the court, proving that the accident was caused by the truck driver's negligence, which led to Asharam's premature death. Asharam's family was financially dependent on him, so his death came as a severe blow to them.

The court, after considering all the evidence, including the postmortem report, the police case, witness statements, and the circumstances of the accident, found that the truck driver was clearly at fault. Based on this, the Motor Accident Claims Tribunal ordered a total compensation of ₹43,58,700 to the family of the deceased Asharam Meghwal. This amount was also ordered to be paid with 7% annual interest from October 31, 2021.

This decision not only brings relief to the victim's family but also sets an important example of the court's sensitivity and speedy justice in road accident cases. Given the increasing number of road accidents and reckless driving in Bikaner, this decision also serves as a message of awareness.
