नाबालिगों के विरुद्ध अपराधों पर सख्त रुख अपनाते हुए पॉक्सो कोर्ट द्वितीय, चूरू ने एक अहम फैसला सुनाया है। वर्ष 2024 में 14 वर्षीय नाबालिग का घर से अपहरण कर दुष्कर्म करने के मामले में आरोपी युवक को 20 वर्ष के कठोर कारावास और 45 हजार रुपये के जुर्माने से दंडित किया गया है। न्यायालय ने नाबालिग की कम उम्र को देखते हुए अपराध को अत्यंत गंभीर माना।

मामले की जानकारी देते हुए विशिष्ट लोक अभियोजक हेमसिंह शेखावत ने बताया कि 15 सितंबर 2024 को जिले के एक थाने में नाबालिग के दादा द्वारा रिपोर्ट दर्ज करवाई गई थी। रिपोर्ट में बताया गया कि उनकी 14 वर्षीय नाबालिग पोती को एक युवक घर से अपहरण कर ले गया और उसके साथ दुष्कर्म की वारदात को अंजाम दिया।

पुलिस ने मामले को गंभीरता से लेते हुए आरोपी के खिलाफ नामजद मामला दर्ज किया और त्वरित जांच शुरू की। जांच के दौरान आवश्यक साक्ष्य जुटाए गए, पीड़िता के बयान दर्ज किए गए और आरोपी को गिरफ्तार कर न्यायालय में चालान पेश किया गया। अभियोजन पक्ष ने अदालत के समक्ष ठोस साक्ष्य प्रस्तुत किए, जिससे आरोप सिद्ध हुए।

मुकदमे की सुनवाई के दौरान कुल 15 गवाहों के बयान दर्ज किए गए और 20 दस्तावेजी साक्ष्य अदालत में पेश किए गए। न्यायालय ने सभी साक्ष्यों और गवाहियों का सूक्ष्मता से परीक्षण किया। नाबालिग की उम्र 16 वर्ष से कम होने के कारण पॉक्सो अधिनियम के तहत अपराध को अत्यंत संगीन मानते हुए अदालत ने कड़ी सजा सुनाई।

मंगलवार को सुनाए गए फैसले में विशिष्ट न्यायाधीश पॉक्सो कोर्ट ने आरोपी को 20 साल के कठोर कारावास के साथ 45 हजार रुपये का जुर्माना लगाया। अदालत ने अपने आदेश में कहा कि इस प्रकार के अपराध समाज की जड़ों को कमजोर करते हैं और नाबालिगों की सुरक्षा के लिए कठोर दंड आवश्यक है।

सरकार की ओर से मामले की प्रभावी पैरवी विशिष्ट लोक अभियोजक हेमसिंह शेखावत ने की। उन्होंने कहा कि यह फैसला न केवल पीड़िता को न्याय दिलाने की दिशा में महत्वपूर्ण है, बल्कि समाज में यह स्पष्ट संदेश भी देता है कि नाबालिगों के खिलाफ अपराध करने वालों को किसी भी सूरत में बख्शा नहीं जाएगा।

चूरू पॉक्सो कोर्ट सजा का यह निर्णय नाबालिगों की सुरक्षा और कानून के सख्त पालन की दिशा में एक मजबूत कदम माना जा रहा है।

Taking a strict stance against crimes against minors, the POCSO Court II in Churu has delivered a significant judgment. In a case from 2024 involving the abduction and rape of a 14-year-old minor, the accused young man has been sentenced to 20 years of rigorous imprisonment and a fine of Rs. 45,000. The court considered the crime extremely serious due to the minor's young age.

Providing details of the case, Special Public Prosecutor Hemsingh Shekhawat said that on September 15, 2024, a report was filed at a police station in the district by the minor's grandfather. The report stated that a young man had abducted his 14-year-old granddaughter from her home and committed rape.

The police took the matter seriously, registered a case against the accused, and launched a swift investigation. During the investigation, necessary evidence was collected, the victim's statement was recorded, and the accused was arrested and presented before the court. The prosecution presented strong evidence to the court, proving the charges.

During the trial, statements of a total of 15 witnesses were recorded, and 20 documentary pieces of evidence were presented in court. The court meticulously examined all the evidence and testimonies. Considering the minor's age to be less than 16 years, the court deemed the crime extremely heinous under the POCSO Act and handed down a harsh sentence.

In the judgment delivered on Tuesday, the Special Judge of the POCSO Court sentenced the accused to 20 years of rigorous imprisonment along with a fine of Rs. 45,000. The court stated in its order that such crimes weaken the fabric of society and that strict punishment is necessary for the protection of minors.

The case was effectively argued on behalf of the government by Special Public Prosecutor Hemsingh Shekhawat. He said that this judgment is not only important in providing justice to the victim but also sends a clear message to society that those who commit crimes against minors will not be spared under any circumstances. This verdict by the Churu POCSO court is considered a strong step towards the protection of minors and the strict enforcement of the law.
