सुप्रीम कोर्ट का बड़ा आदेश: अरावली पर केंद्र के फैसले पर रोक, पूर्व सिफारिशें स्थगित; खनन पर प्रतिबंध यथावत

अरावली संरक्षण मामले में सुप्रीम कोर्ट ने बड़ा निर्णय सुनाते हुए केंद्रीय पर्यावरण मंत्रालय के 20 नवंबर 2025 के आदेश और समिति की सिफारिशों पर फिलहाल स्थगन (Stay) दे दिया है। अदालत ने स्पष्ट कहा कि बिना स्वतंत्र विशेषज्ञ राय और पारदर्शी परामर्श प्रक्रिया के किसी भी नई परिभाषा या नीति को लागू नहीं किया जा सकता। साथ ही अदालत ने निर्देश दिया कि अगले आदेश तक कोई भी नई कार्रवाई नहीं की जाएगी और यथास्थिति बरकरार रहेगी।

वन एवं पर्यावरण से जुड़े इस महत्वपूर्ण मामले में कोर्ट ने केंद्र सरकार के निर्णय पर सवाल उठाते हुए कहा कि अरावली रेंज की परिभाषा स्पष्ट न होने से गलत व्याख्या और खनन गतिविधियों के दुरुपयोग का खतरा बढ़ सकता है। अदालत ने भारत सरकार के पर्यावरण मंत्रालय और दिल्ली, राजस्थान, हरियाणा और गुजरात को नोटिस जारी कर विस्तृत स्पष्टीकरण मांगा है।

अशोक गहलोत ने फैसले पर जताई खुशी

राजस्थान के पूर्व मुख्यमंत्री अशोक गहलोत ने सुप्रीम कोर्ट के आदेश का स्वागत किया। उन्होंने कहा कि जनता और पर्यावरण प्रेमियों की आवाज सुनने के लिए न्यायालय का यह निर्णय सकारात्मक कदम है।

गहलोत ने आगे कहा कि सरिस्का समेत अरावली में खनन बढ़ाने की सोच पर्यावरण के लिए खतरा है और सरकार को दीर्घकालिक दृष्टि से काम करना चाहिए।

भारत संघ की ओर से सॉलिसिटर जनरल तुषार मेहता ने कोर्ट में कहा कि रिपोर्ट में कुछ भ्रांतियां हैं और सरकार सहयोग के लिए तैयार है। उन्होंने बताया कि कोई भी सुझाव कोर्ट की स्वीकृति के बिना लागू नहीं किया जाएगा, और भविष्य में पब्लिक कंसल्टेशन के जरिए हितधारकों की राय ली जाएगी।

पर्यावरण संरक्षण के लिए राहत मानी जा रही है

विशेषज्ञों का कहना है कि यह निर्णय अरावली संरक्षण की दिशा में महत्वपूर्ण है, क्योंकि अनियंत्रित खनन और भू-आकृति कटाव से क्षेत्र के जल स्रोत, वन्यजीव और जलवायु संतुलन पर गंभीर प्रभाव पड़ सकता है। अदालत का स्टे आगे की नीति निर्धारण में संतुलन और वैज्ञानिक दृष्टिकोण सुनिश्चित करेगा।

यह आदेश फिलहाल अरावली पर किसी नई गतिविधि या नीति बदलाव को रोक देता है और पर्यावरण सुरक्षा को प्राथमिकता देता है। आगे की सुनवाई से यह तय होगा कि अरावली संरक्षण का अंतिम ढांचा किस रूप में लागू होगा।
