राजधानी जयपुर में अनोखा केस आया है और जब यह मामला कोर्ट पहुंचा तो कोर्ट ने भी इस मामले में सुनवाई की। सुनवाई के बाद पत्नी के पक्ष में फैसला दिया और पति की एफआईआर को खारिज कर दिया गया। मामला राजधानी जयपुर का बताया जा रहा है और जोधपुर हाईकोर्ट में उसे ले जाया गया था।

जब पति ने पुलिस को पत्नी की दी शिकायत
दरअसल जयपुर में रहने वाले एक शख्स ने पुलिस थाने में अपनी पत्नी के अपहरण की सूचना दी और रिपोर्ट दर्ज कराई। पत्नी के पास जब यह सूचना पहुंची तो उसने कोर्ट में इस मामले को चुनौती दे दी। वह कोर्ट में तमाम दस्तावेज और अपहरण करने वाले कथित आरोपी के साथ पहुंची। उसक नाम संजीव है।

शादी के बाद से पराए मर्द के साथ रहती है पत्नी
पत्नी ने कोर्ट में कहा कि वह खुद अपनी मर्जी से संजीव के साथ रह रही है। उसका अपहरण नहीं किया गया है। पति ने इस मामले में झूठ बोला है। पति के वकील ने कोर्ट में दलील दी कि पत्नी ने स्वीकार किया है कि वह शादी के बाद भी पराये मर्द के साथ रह रही है। इस कारण आईपीसी सेक्शन 494 और 497 के तहत यह अपराध बनता है।

कोर्ट ने कहा-शादीशुदा महिला मर्जी से किसी से बना सकती है संबंध
इस पर हाईकोर्ट ने सुप्रीम कोर्ट के आदेश का हवाला देते हुए कहा कि यह सच है कि हमारे समाज में मुख्यधारा का विचार यह है कि शारीरिक संबंध केवल शादीशुदा जोड़े के बीच हो, लेकिन जब शादी से इतर दो व्यस्क सहमति से संबंध बनाते हैं तो यह अपराध नहीं है। कोर्ट ने कहा कि सहमति के साथ दो विपरित लिंग के व्यस्क साथ रह सकते हैं। महिला व्यस्क है वह अपनी मर्जी से रह रही है। कोर्ट ने यह भी कहा कि यह आईपीसी 494 के यानी दो विवाह करने वाली धारा में केस नहीं बनता है। क्योंकि पति या पत्नी ने अपने जीवन काल में दूसरी शादी नहीं की है। कोर्ट ने कहा कि लिव इन रिलेशनशिप धारा 494 के तहत नहीं आता.....।

When the husband complained about his wife to the police

Actually, a man living in Jaipur informed the police station about the kidnapping of his wife and lodged a report. When this information reached the wife, she challenged the matter in the court. She reached the court with all the documents and the alleged kidnapper. His name is Sanjeev.

Wife lives with another man after marriage

The wife told the court that she was living with Sanjeev of her own free will. He has not been kidnapped. The husband has lied in this matter. The husband's lawyer argued in the court that the wife had admitted that she was living with a stranger even after marriage. For this reason it constitutes a crime under IPC sections 494 and 497.

Court said – married woman can have relationship with anyone as per her wish

On this, the High Court, citing the order of the Supreme Court, said that it is true that the mainstream idea in our society is that physical relations should happen only between married couples, but when two adults have consensual relations outside marriage, then it is is not a crime. The court said that two adults of opposite sex can live together with consent. The woman is an adult and is living on her own free will. The court also said that this does not constitute a case under the section of IPC 494 i.e. bigamy. Because the husband or wife has not remarried during his lifetime. The court said that live-in relationship does not come under section 494.
