बीकानेर जिले से एक महत्वपूर्ण कानूनी फैसला सामने आया है। मोटरयान दुर्घटना दावा अधिकरण ने लूणकरणसर क्षेत्र में हुए एक सड़क हादसे के मामले में मृतका के परिवार के पक्ष में बड़ा निर्णय सुनाते हुए ₹1,01,41,500 मुआवजा देने का आदेश दिया है। यह राशि न्यू इंडिया इंश्योरेंस कंपनी लिमिटेड द्वारा देय होगी।

यह मामला 9 सितंबर 2020 की सुबह हुई उस दर्दनाक दुर्घटना से जुड़ा है, जिसमें शिक्षिका मंजूबाला डूडी अपनी स्कूटी से लूणकरणसर जा रही थीं। जब वे शिव जंभेश्वर गोशाला के पास रोझां रोड से गुजर रही थीं, तभी सामने से आ रहे एक ट्रैक्टर ने तेज रफ्तार और लापरवाही से वाहन चलाते हुए उनकी स्कूटी को जोरदार टक्कर मार दी। हादसा इतना भीषण था कि मंजूबाला गंभीर रूप से घायल हो गईं और इलाज के दौरान उनकी मृत्यु हो गई।

दुर्घटना के बाद मृतका के पति शंकरलाल एवं बच्चों ने मोटर वाहन दावा अधिकरण में मुआवजे के लिए अर्जी दाखिल की। उन्होंने आरोप लगाया कि ट्रैक्टर चालक रामदयाल ने अत्यधिक लापरवाही बरती, जिसके कारण यह दुर्घटना हुई। मामले की सुनवाई के दौरान अदालत ने प्रस्तुत साक्ष्यों, पुलिस रिपोर्ट, मेडिकल अभिलेखों और गवाहियों का गहन परीक्षण किया।

पीठासीन अधिकारी अनवर अहमद चौहान ने अपने फैसले में माना कि हादसा ट्रैक्टर चालक की सीधी लापरवाही से हुआ और मृतका के परिवार को उचित मुआवजा मिलना चाहिए। न्यायालय ने मृतका की आय, उम्र, आश्रित परिवार, भविष्य की संभावनाओं तथा अन्य कारकों को ध्यान में रखते हुए मुआवजा राशि निर्धारित की।

न्यायालय ने बीमा कंपनी को निर्देश दिया कि वह यह राशि 31 अक्टूबर 2020 से 7 प्रतिशत वार्षिक ब्याज सहित परिवार को अदा करे। यह आदेश पीड़ित परिवार के लिए एक बड़ी राहत है, जिसने हादसे के बाद आर्थिक और मानसिक रूप से भारी कठिनाइयों का सामना किया था।

मामले ने फिर एक बार यह उजागर किया है कि तेज रफ्तार और लापरवाही से वाहन चलाने के क्या गंभीर परिणाम हो सकते हैं। शिक्षिका मंजूबाला डूडी अपने परिवार की आधार थीं और उनके निधन ने पूरे परिवार को असहाय कर दिया। न्यायालय का यह फैसला सड़क दुर्घटना पीड़ितों के लिए एक महत्वपूर्ण उदाहरण है कि कानून उनके अधिकारों की रक्षा करता है और दोषी पक्ष को जवाबदेह ठहराता है।

The Motor Accident Claims Tribunal has issued a significant verdict in favor of the family of the deceased in a road accident in the Lunkaransar area, awarding compensation of ₹1,01,41,500. This amount will be paid by New India Insurance Company Limited.

This case relates to the tragic accident that occurred on the morning of September 9, 2020, when teacher Manjubala Dudi was traveling to Lunkaransar on her scooter. While passing through Rojhan Road near the Shiv Jambheshwar Gaushala, a tractor coming from the opposite direction, driven at high speed and recklessly, struck her scooter. The accident was so severe that Manjubala was seriously injured and died during treatment.

Following the accident, the deceased's husband, Shankarlal, and children filed a petition for compensation with the Motor Vehicle Claims Tribunal. They alleged that the tractor driver, Ramdayal, acted with extreme negligence, leading to the accident. During the hearing, the court thoroughly examined the evidence presented, including the police report, medical records, and testimonies.

Presiding Officer Anwar Ahmed Chauhan concluded in his decision that the accident was caused by the tractor driver's direct negligence and that the deceased's family deserved appropriate compensation. The court determined the compensation amount after considering the deceased's income, age, dependent family, future prospects, and other factors.

The court directed the insurance company to pay the amount to the family, along with 7 percent annual interest, effective October 31, 2020. This order is a major relief for the victim's family, who faced significant financial and mental hardships following the accident.

The case has once again highlighted the serious consequences of rash and negligent driving. Teacher Manjubala Dudi was the pillar of her family, and her passing has left the entire family devastated.
